TERMS & CONDITIONS

PLEASE READ THESE TERMS CAREFULLY, AS THEY CONTAIN LEGALLY BINDING OBLIGATIONS.  PLEASE PRINT AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE.

 

What these terms cover. These are the terms and conditions on which we supply products to you, whether these are goods, services or accessibility to our video content.

  • Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

  1. How we may contact you.

1a. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.

1b. “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.

 

2.Our contract with you

2a. How we will accept your order. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.

2b. If we cannot accept your order. If we are unable to accept your order, we will inform you of this in writing and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

2c. Your reference number. We will assign a reference number to your order which will be related to your account profile with us. This will show on your order. It will help us if you can tell us the order number whenever you contact us about your order.

 

3.Personal Information

3a. We will only use information in accordance with our Privacy Policy which is available to view on our website. Please read carefully as there are important terms which apply to you.

4. Consumer Age

4a. You may only purchase Products from our site if you are at least 16 years old.

5.  Availability & Delivery.

5a. Delivery costs. The costs of delivery will be automatically calculated for you on our website, depending on the delivery destination and postal charges.

5b. When we will provide the products. During the order process, we will let you know when we will provide the products to you.

 5c. If the products are goods. If the products are goods we will deliver them to you as soon as reasonably possible and in any event within three working days after the day on which we accept your order for deliveries within the UK (so long as the correct delivery details are provided to us). If you order within the UK you will receive an email/text from us informing you when delivery will take place. The time for overseas delivery will vary depending on any delays with customs. We would estimate however that you should receive your delivery in 30 days. You can email our customer services team to track your order if it has been delayed.

 

5d. Missing goods – please note that our orders are checked for content by staff and checked against an order list before despatch. Therefore it is extremely unlikely that a mistake will be made in respect of the content. If we suspect a fraudulent claim or where there are repetitive claims by an individual, then at our discretion we will not replace the missing goods.

5e. Invoice and packaging will be required as photographic evidence in order for us to investigate missing items.

5f. We are not responsible for delays outside our control. If our supply of the products is delayed which is outside of our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received. The time for overseas delivery will vary depending on any delays with customs, which we are not liable for. South Africa customs, in particular, are experiencing long delays, and orders may not be cleared for many weeks.

5g. Providing the correct shipping address.  The customer is responsible for providing us with the correct shipping details. We cannot be held responsible for deliveries made to incorrect or incomplete addresses provided by customers. We post all orders to the address that you provide us with, so please check your order confirmation email to ensure that the address is completely correct. If you spot a mistake please email us to let us know as soon as possible so that we can have this amended before shipping. In any instance where the address that you have provided is not 100% correct, and your order is shipped, we will need to wait for the parcel to be returned if we are to provide any kind of re-delivery / refund.

 

5h. If you are not at home when the product is delivered. If no one is available at your address to take delivery and the products cannot be posted through your letterbox, we will leave you a note informing you that we have tried to deliver. For deliveries in the UK, it will be your responsibility to re-order the Goods that could not be delivered and this can be done through our website. For overseas deliveries, our courier service will make three attempts to deliver and then the Goods will be sent back to us.

5i. If you do not re-arrange delivery. If, after a failed delivery to you, you do not re-arrange delivery or collect the goods from us we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract and clause 2 will apply.

5j. When you become responsible for the goods. A product which is goods will be your responsibility from the time we deliver the product to the address you gave us (or you collect those goods from us).

5k. When you own goods. You own a product which is goods once we have received payment in full.

5l. What will happen if you do not give the required information to us. We will need certain information from you so that we can supply the products to you, for example, name, address, email address. If so, this will have been stated in the description of the products on our website. We will contact you to ask for this information. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may either end the contract (and clause 2 will apply) or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be responsible for supplying the products late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.

5m. Reasons we may suspend the supply of products to you. We may have to suspend the supply of a product to:

  • deal with technical problems or make minor technical changes;

  • update the product to reflect changes in relevant laws and regulatory requirements;

 

5n. Below are your rights if we suspend the supply of products. We will contact you in advance to tell you we will be suspending supply of the product unless the problem is urgent or an emergency. You may contact us to end the contract for a product if we suspend it, or tell you we are going to suspend it, in each case for a period of more than four weeks and we will refund any sums you have paid in advance for the product in respect of the period after you end the contract. This excludes pre-orders when you will be notified of the lead-up time for the stock to be made available for delivery.

5o. We may also suspend supply of the products if you do not pay. If you do not pay us for the products when you are supposed to (see clause 4) and you still do not make

5p.Damaged / Faulty products.  If you deem your product(s) to be damaged or faulty you will need to contact us within 14 working days of receiving your item(s) to make us aware of the issue. If you contact us regarding your product(s) being damaged or faulty outside of this time frame it will be down to the discretion of the management as to whether you are eligible for an exchange or refund

 

6. RETURNS, REFUNDS AND REPLACEMENTS

6a. If a customer wishes to return any item for any reason, they are invited to first contact our Customer Care team via email info@timeneys.com to discuss any specifics, or if they require clarification on any of the following points.

6b. Customers are welcome to return any unwanted items that are unused and in original packaging to our warehouse within 14 days of receipt of the parcel.  unless your goods are split into several deliveries over different days. In this case, you have until 14 days after the day you receive the last delivery.

6c. When returning parcels, please be advised that:

  • The customer is responsible for all return fees incurred when posting items back to Timeneys. When we will pay the costs of return. We will pay the costs of return if the products are faulty or were wrongly described. In all other circumstances (including where you are exercising your right to change your mind) you must pay the costs of return.

  • The customer must include a note with their return specifying their order number, full name and the type of remuneration desired (refund, exchange, replacement)

  •  No remuneration can be given before the products have been received by our staff. The customer is therefore advised to send any returns with a trackable option.

6d. Returned items can be refunded, exchanged for an alternative item, or replaced like for like.

6e. REFUNDS

6f. Refunds can be given for items returned within the 14 days.

6g. Refunds will be issued only when the returned items have been received by our staff and may take up to 10 business days to reach the recipient's account once the refund is processed, depending on the recipient's bank. When an item is returned for a refund, please note that the original shipping fees are not liable to be refunded.

6h. The return address will be provided via email when you request a return.

 

6i. Exchanging an Item

6j.If you change your mind about an item, we can offer an exchange. Contact us via the following method:

 

6k. You are responsible for paying for all shipping costs when returning an item for exchange unless otherwise stated by Timeneys.

6l. The time it may take for your exchanged product to reach you may vary, dependent on where you live.

6m. Customers are responsible for paying any customs/ import duties on their purchases. Timeneys accepts no responsibility for any unexpected additional fees made by anyone after your order has been shipped by us.

6n. When consumers do not have a right to change their minds. Your right as a consumer to change your mind does not apply in respect of:

  • make-up products which have been opened and used or where products have been sealed for health protection or hygiene purposes, once these have been unsealed after you receive them.

7. Contract

7a. Our rights to end the contract

7b. We may end the contract if you break it. We may end the contract for a product at any time by writing to you if:

7c. you do not make any payment to us when it is due and you still do not make payment within three days of us reminding you that payment is due;

7d. you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products, for example, clear details of your name, shipping address or email address; or

7e. you do not, within a reasonable time, allow us to deliver the products to you or collect them from us.

7f. You must compensate us if you break the contract. If we end the contract in these situations, we will refund any money you have paid in advance for products we have not provided but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.

7g. We may withdraw the product. We may write to you to let you know that we are going to stop providing the product. We will let you know as soon as we possibly can in advance of our stopping the supply of the product and will refund any sums you have paid in advance for products which will not be provided.

 

8. Faults

8a. If there is a problem with the product

How to tell us about problems. If you have any questions or complaints about the product, please contact us at info@timeneys.com. You must notify us in writing where you have a claim for faulty products within one week of delivery so that we can pass on the details to our manufacture in a timely manner. Please email customer services (details above) setting out full details of your claim or description of the fault with the product.

9. Price and payment

9a. Where to find the price for the product. The price of the product (which includes VAT) will be the price indicated on the website order pages when you placed your order. We use our best efforts to ensure that the price of the product advised to you is correct. However please see above for what happens if we discover an error in the price of the product you order.

9b. We will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect. The prices that show on the website are VAT inclusive.

9c. What happens if we get the price wrong? It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced on our website.  In this instance, we will contact you to let you know as soon as possible, as we may have to cancel your order.

9d. When you must pay and how you must pay. We accept payment with most debit cards and credit cards (more details are available on the website). When you must pay depends on what product you are buying:

  • For Goods, you must pay for the products before we dispatch them.

 

9e. What to do if you think an invoice is wrong. If we send you an invoice and you think an invoice is wrong please contact us promptly to let us know.

9f. Discount Codes: Discount codes are for a limited time and use only. Only one discount code can be used at any one time. If you are found to be abusing the discount codes, your order may be cancelled and we may block any future orders. Please also note that we will investigate any discount code abuse. The investigation will be carried out at Timeneys.

9g. If you incur a customs charge. Unfortunately, customs charges are completely out of our control. You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.

10. Our Liability

10a. Our responsibility for loss or damage suffered by you if you are a consumer. We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

 

10b. We are not liable for business losses. As a consumer, we only supply the products to you for domestic and private use. If you use the products for any commercial, business or resale purpose our liability to you will be limited.

10c. Except to the extent expressly stated in clause 1 all terms implied by sections 13 to 15 of the Sale of Goods Act 1979 and sections 3 to 5 of the Supply of Goods and Services Act 1982 are excluded.

10d. Subject to clause 1:

  • we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any contract between us; and

  • our total liability to you for all other losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the value of your order for Goods or online courses paid by you under the contract.

10e. We are under a legal duty to provide Products which comply with the terms of the Contract. You should also be aware that consumer sales in the UK are subject to governance by organisations such as the OFT, the Department of Enterprise, Trade and Investment in Northern Ireland and the Trading Standards Institute, and subject to codes of conduct, further details of which can be found at http://www.tradingstandards.gov.uk/advice/.

11. Data protection & security checks

11a. How we may use your personal information

11b. How we will use your personal information. We will only use your personal information as set out in our Privacy Policy.

Other important terms:

11c. We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation.

11d. You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

11e. Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms.

11f. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

11g. Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.

11h. Which laws apply to this contract and where you may bring legal proceedings as a consumer. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.

To ensure that your credit, debit or charge cards are not being used without your consent, we validate your name, address and other personal data against information held on appropriate third party databases.  This is done only to confirm your identity; a credit check is not performed and your credit rating will not be affected. By accepting these terms, you consent to us carrying out such checks, whereby registered credit reference agencies may retain a record of the data disclosed to them. 

 

11i.  All information given to us by you will be used only in accordance with EU GDPR regulations, and if, at any time, you wish to be removed from any of our mailing lists or records, you should write to us via email at info@timeneys.com.

12. Complaints

 

12a. Complaints Procedure.  If for any reason you wish to make a complaint, please use the following:

  • Please put your complaint into an email; please email info@timeneys.com

  • We ask that you allow up to 72 hours for the complaint to be acknowledged.

  • We may take up to 28 days to fully resolve your complaint, this could include asking you for any evidence you may have.

  • If at any point throughout the 28 days, you post on any social media platforms, anything that could be detrimental to Timeneys, this could jeopardise your complaint: this resulting in your complaint being rejected and unresolved.

 

13.  Law and jurisdiction

 

 This contract is between you and us. No other person shall have any rights to enforce any of its terms.

Please note that these Terms are governed by English Law. This means a contract for the purchase of products through our site and any dispute or claim arising out of or in connection with it will be governed by English Law. You and we both agree that the Courts of England and Wales will have non – exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
